TERMS AND CONDITIONSÂ & RELEASE OF LIABILITY
These are the terms and conditions required in order to register for and participate in a retreat hosted by Thriving Together LLC, a North Carolina limited liability company.
This Terms and Conditions and Release of Liability Agreement (the "Agreement") is a legally binding contract between Thriving Together LLC ("Host", "we", "us", or "our") and the undersigned individual ("Participant", "you", or "your"). By submitting a deposit or payment for this retreat, you agree to be bound by all the terms outlined below.Â
1. Registration, Deposit, and Payment Terms
- Registration Structure: To secure a registration slot for the retreat, Participant may choose one of two payment paths at checkout:
- Pay in Full: Payment of the complete retreat package fee upfront upon registration.
- Deposit + Payment Plan: Submission of a $500.00 USD deposit (the "Deposit") accompanied by immediate enrollment in a structured interim payment plan.Â
- Cooling-Off Period: If Participant requests a cancellation in writing within seven (7) calendar days of the initial transaction timestamp, Host will refund all amounts paid to date minus the $40.00 USD admin fee. After seven (7) calendar days, all payments become completely non-refundable.Â
- Payment Methods and Processing Fees: Payments may be made via bank transfer (ACH) or major credit card. If Participant selects the credit card payment option, Participant agrees to pay all associated credit card processing fees, which will be added to the transaction total at checkout.
2. Cancellation, Refund, and Transfer Policies
- Finality of Payments: Except for the 7-day cooling-off period described in Section 1, all payments made toward the retreat—including the Deposit and subsequent balance payments—are strictly non-refundable.Â
- All-Inclusive Package Structure; No Partial Credits: The retreat is sold strictly as a complete, unified experience package. Thriving Together LLC does not offer itemized pricing, pro-rata adjustments, or discounts for late arrivals, early departures, missed meals, or voluntary non-participation in any scheduled yoga sessions, hikes, or inclusions. Unused components of the retreat itinerary carry no cash value and are entirely non-refundable.
- Cancellation by Participant: If Participant is unable to attend, monies paid may be refunded to the Participant minus a $100 admin fee provided that:
- The Participant individually finds someone else to take their spot.
- The replacement individual agrees to all terms of this Agreement; and
- Written notice of the transfer is provided to the Host no later than fourteen (14) days prior to the retreat start date.
- If you are in a shared room, the roommate(s) have the right to decline the replacement, in which case the Participant will not be eligible for a refund.
- Cancellation by Host: If the retreat is cancelled by Thriving Together LLC due to low enrollment, operational constraints, or safety concerns, Host will issue a full refund of all monies paid by Participant to Host. Host is not responsible for any peripheral or consequential expenses incurred by Participant, including but not limited to non-refundable airline tickets or travel gear.
- Force Majeure (Unforeseen Events): If the retreat must be delayed, shortened, altered, or cancelled due to a Force Majeure event—defined as any circumstance beyond the reasonable control of the Host, including acts of God, natural disasters, extreme alpine weather or avalanche closures, wars, terrorism, strikes, pandemics, epidemics, or government-imposed travel restrictions and border closures—Host shall not be deemed in breach of this agreement. In a Force Majeure scenario, Host is not liable for refunds of monies already committed to non-refundable international venues or vendors. Host will make reasonable efforts to recover and pass through vendor funds or provide credit toward a future event, but cannot guarantee a refund. Participant acknowledges that their primary financial protection against Force Majeure events is the independent purchase of travel insurance.
- Teacher Substitution: The retreat is scheduled to be co-led by two primary instructors. If one instructor becomes unable to lead the trip due to illness, injury, emergency, or any other unforeseen reason, the remaining instructor will assume sole responsibility and guide the entire trip. If both primary instructors become unable to lead, Thriving Together LLC reserves the right to substitute alternative, similarly qualified movement or yoga educators to run the retreat. Participant explicitly agrees that a change in the specific instructors leading the retreat does not constitute a breach of contract, and no refunds, partial credits, or financial compensation will be issued under these circumstances.
3. Arrival Logistics and Travel Insurance
- Included Ground Transportation: Host provides scheduled group pickup coordination from either Lyon Airport (LYS) or the Chambéry Train Station. Host additionally provides group drop-off to the Chambéry Train Station.
- Independent Travel Responsibility: If Participant arrives at an airport or terminal other than Lyon Airport or Chambéry Train Station, Participant is entirely responsible for arranging and financing their own transportation to the Chambéry Train Station to meet the group arrival transfer. Participant is solely responsible for arranging and paying for all international and domestic airfare.
- Travel Insurance Recommendation: No travel insurance is included in the retreat purchase and the Participant is fully responsible for any financial loss incurred if unable to attend for any reason or if Participant needs to leave early. Host strongly recommends that Participant purchases comprehensive travel insurance immediately upon registration. It is highly advised that this policy includes Cancel For Any Reason (CFAR) coverage and international medical evacuation protection to safeguard against financial loss from unexpected medical emergencies, travel delays, or personal cancellations. CFAR policies must be purchased within 14 days of initial payment.
4. Scope of Services, Gear, and Physical Requirements
- Included Services: The baseline retreat package price includes lodging, all meals provided during the retreat dates, yoga mats, yoga props, guided hikes, and professional yoga instruction. Hikes originate directly from the lodging site.
- Excluded Services: The retreat package explicitly excludes airfare, alcoholic beverages, professional massages, and Nordic spa facility sessions.
- Required Equipment: Participant must bring broken-in hiking shoes or boots, and personal water bottles or hydration pouches capable of carrying adequate water for outdoor activity.
- Recommended Equipment: Trekking poles are optional but strongly recommended for any individuals managing stability, joint strain, or endurance concerns.
- Physical Thresholds and Health Status: All yoga and hiking activities are optional; there is no mandatory mileage baseline. However, Participant acknowledges that the retreat takes place at elevation and that altitude can significantly impact physical capacity, oxygen consumption, and cardiac output. At a minimum, Participant represents that they possess the physical mobility to independently lower themselves to the floor and rise back up to a standing position without assistance.
5. Assumption of Risk and Release of Liability
- Inherent Risks: Participant acknowledges that yoga instruction, functional movement, and mountain hiking involve inherent risks. These risks include, but are not limited to: slips, trips, falls, variable mountainous weather patterns, rough or uneven terrain, and altitude sickness.
- Voluntary Participation: Participant explicitly chooses to participate in these activities voluntarily and assumes all risks of personal injury, illness, property damage, lost income, or death resulting from these inherent dangers.
- Liability Release: Participant hereby releases, waives, discharges, and covenants not to sue Thriving Together LLC, its owners, officers, employees, independent contractors, and agents from any and all liability, claims, demands, or causes of action arising out of or related to any loss, damage, lost income, injury, or death that may be sustained by Participant during the retreat, unless caused by gross negligence or willful misconduct of the Host.
6. Code of Conduct and Dismissal
- Participant agrees to comply with all local safety regulations, instructions provided by Host. Host reserves the unilateral right to dismiss any Participant from the retreat without a refund if their behavior is deemed disruptive, unsafe, or abusive to other attendees, staff, or venue personnel.
7. Optional Media and Photography Release

By initialing above, Participant grants Thriving Together LLC permission to capture their photographic image, video footage, or audio recording during the retreat and to utilize these assets for future promotional, marketing, and commercial purposes without financial compensation. Leaving this section blank constitutes a non-agreement, and Host will take reasonable operational steps to exclude Participant from marketing media.
8. Governing Law and Jurisdiction
- This Agreement shall be governed by, construed, and enforced in accordance with the internal laws of the State of North Carolina, without regard to principles of conflicts of law. Any legal action, mediation, or proceeding arising out of or relating to this contract must be filed exclusively within the state or federal courts located in North Carolina.

By signing below, I certify that I have read this entire document, fully understand its financial and legal implications, and agree to be bound by its terms. Agreement to these terms is a requirement for participation in a retreat by Thriving Together LLC.
